Refund Policy

Note: This Refund Policy complies with EU Consumer Rights Directive (2011/83/EU), German Civil Code (§§ 312 et seq. BGB), and applies to sales of unique/limited edition bronze sculptures. It supplements our GTC and Shipping Policy. Not legal advice—consult a lawyer for customization.

1. Scope

This policy governs refunds for orders placed via eternal-fungi.art. Refunds are limited to consumers exercising statutory rights or proven defects. No refunds for change of mind on non-withdrawable items (see below).

 
2. Right of Withdrawal (Consumers Only)

  • Period: 14 days from receipt of goods (Art. 9 CRD / § 355 BGB).

  • How to Withdraw: Notify us via email (w.fotojournalism@gmail.com) or return goods. Use model form below if desired.

  • Exceptions (§ 16 CRD / § 312g BGB): No withdrawal for:

    • Personalized/custom artworks.

    • Unique sculptures made to your specifications (informed pre-order).

  • Return Process: Return in original condition/packaging at your cost (unless defective). We refund purchase price (excl. shipping) within 14 days of receipt/inspection proof, using original payment method—no fees charged.

  • Risk: Goods travel at your risk until received by us.

3. Defects and Warranty Claims

  • Warranty Period: 2 years from delivery (§§ 437, 438 BGB).

  • Process: Notify defects within 2 months of discovery (§ 377 HGB for businesses). Provide photos/evidence.

  • Remedy: Repair, replacement, price reduction, or refund at our discretion. Return shipping at our cost for valid claims.

  • Exclusions: Damage from improper handling, transport, or normal wear.

 
4. Refund Processing

  • Timeline: Within 14 days of valid claim confirmation/receipt.

  • Amount: Full purchase price paid (excl. original shipping unless defective). No refunds on shipping for withdrawals.

  • Method: Same as payment (bank transfer/PayPal)—no cash/cheques.

  • Non-Refundable: Custom orders post-production start; shipping fees (outbound); non-defective returns.

 
5. International Returns

  • EU: Standard rules apply.

  • Non-EU: Buyer bears customs/duties on return; refunds excl. these fees.
