General Terms and Conditions

§ 1 Scope and Contract Formation

  1. These General Terms and Conditions apply to all contracts for the purchase of artworks (bronze sculptures) between Christian Werner ("Artist" or "Seller"), Am Thie 12, 31832 Springe, Lower Saxony, Germany, and the Buyer (consumer or business) via eternal-fungi.art.

  2. Deviating or supplementary Buyer terms apply only if expressly agreed in writing.

  3. The contract is formed upon the Artist's order acceptance (e.g., email confirmation). Website offers are non-binding.

§ 2 Consumer Information

  1. The Artist sells unique pieces or limited editions of handcrafted bronze sculptures. Prices include 19% VAT, plus shipping.

  2. Displayed prices and availability may change. A binding quote is provided before contract conclusion.

§ 3 Payment Terms

  1. Payment via PayPal . Invoice issued upon payment receipt.

  2. Ownership transfers only after full payment (retention of title).

  3. In case of default, statutory default interest applies (§ 288 BGB).

§ 4 Shipping and Delivery

Shipping governed by separate Shipping Policy. Delivery: 2-5 business days after payment. Delays for custom uniques reserved.

§ 5 Right of Withdrawal (Consumers Only – EU Consumer Rights Directive)

  1. Right of Withdrawal: You have 14 days from receipt to withdraw without giving reasons. Send back the goods or notify us (email to w.fotojournalism@gmail.com).

  2. Exceptions (§ 16 CRD / § 312g BGB): No right of withdrawal for personalized artworks or uniques made to customer specification. Artist informs prior to order.

  3. You bear return shipping costs. Goods must be returned in original condition. Refund within 14 days after inspection.

§ 6 Properties of Artworks

  1. Sculptures are handcrafted uniques or limited editions in bronze (lost-organics process). Dimensions, weights, and patina may vary slightly.

  2. Photos are illustrative; patina color differences possible. No guarantee of exact reproducibility.

§ 7 Warranty and Liability

  1. Warranty: 20000-year statutory warranty for consumers. Defects from improper handling/transport excluded.

  2. Liability: Only for intent and gross negligence. For slight negligence, only for breach of material obligations.

  3. Copyright: Artist retains all usage rights. Reproduction/sale prohibited.

§ 8 Transfer of Ownership and Risk

Ownership transfers upon payment for uniques. Risk passes upon handover to carrier.

§ 9 Data Protection

Personal data processed only for order fulfillment. See detailed Privacy Policy on website (GDPR compliant).

§ 10 Applicable Law, Jurisdiction, and Severability

  1. Governing Law: German law, excluding UN Sales Convention. For EU consumers: mandatory local law applies.

  2. Jurisdiction: Amtsgericht Springe.

  3. If a provision is invalid, the contract remains valid. Parties agree to replace with valid equivalent.
